In a patent infringement action, the district court's rulings in favor of plaintiff regarding patents related to methods and devices for sealing a vascular puncture are: 1) reversed as to the ruling that the safe-harbor provision of 35 U.S.C. section 121 protects plaintiff's Janzen patent from invalidity due to double patenting; 2) rendered moot, as to the district court's rulings regarding the claim constructions in the Janzen patent; and 3) affirmed as to the district court's ruling that the Fowler patents are non-obvious and not shown to be invalid.
