Plantronics, Inc. v. Aliph, Inc., 12-1355

In this patent infringement case, in which plaintiff alleges that defendants' products infringe its '453 patent entitled "Concha Headset Stabilizer," the district court's decision granting-in-part defendants' motion for summary judgment of noninfringement and invalidity, construing certain disputed terms, finding in relevant part that the accused products do not infringe claims 1 and 10, and holding the asserted claims invalid as obvious, is reversed in part and vacated in part and remanded, where: 1) the district court erred in construing the terms "stabilizer support member" and "concha stablizer" when it limited them to "elongated" structures, and since the district court's claim construction is reversed, its finding of no infringement is vacated; and 2) the district court failed to give proper consideration to objective evidence of non-obviousness and because evidence pertaining to objective considerations raises genuine issues of material fact, the district court's decision is reversed as to all the asserted claims in this case.
