Judgment of the Court of Federal Claims dismissing plaintiff's back pay claim under the Military Pay Act, which alleged that the Navy acted improperly in failing to assign him to pay billet, is affirmed, where even where a procedural violation is alleged, the matter is nonjusticiable unless the pertinent regulations or instructions provide sufficient "tests or standards" against which the court can measure the military's conduct, as is the case here.
