Judgment for plaintiff in patent infringement suit based on two jury verdicts finding that defendant directly and indirectly infringed specified claims of plaintiff's '395 patent related to a mobile communication protocol, the specified claims of plaintiff's '395 patent are not invalid, and defendant was liable for damages, is: 1) vacated in part and remanded, where the district court gave the jury a legally erroneous instruction with respect to indirect infringement, and defendant's evidence of a good-faith belief of invalidity may negate the requisite intent for induced infringement; but 2) affirmed in part, where the district court did not err in granting a partial new trial.
