Deribeaux v. Secretary of Health and Human Servs., 2012-5127

The United States Court of Federal Claims decision affirming a special master's decision denying plaintiffs' claim for compensation under the National Vaccine Injury Compensation Program for injuries allegedly caused by the Diphtheria-Tetanus-acellular Pertussis (DTaP) vaccine is affirmed where the special master did not apply an incorrect legal standard and her evaluation of the case was not arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law.
