Summary judgment of non-infringement of plaintiff's patent for computerized systems and methods for reporting and forecasting real-time weather information and attorney's fees to defendant is vacated and remanded, where it was improper for the district court to have refused plaintiff's request to delay ruling on defendant's summary judgment motion until plaintiff had the opportunity to access defendant's source code and depose two witnesses.
