United States Federal Circuit

Parks v. Shinseki, 12-7089

The United States Court of Appeals for Veterans Claims did not err in denying service connection for claimant's asserted medical conditions that he alleged were secondary to exposure to chemical warfare agents during the Vietnam War, where claimant waived any right to rebut the presumption that the VA properly chose a person who was qualified to provide a medical opinion in his case, because he never suggested that there was anything improper with the VA's selection of an nurse practitioner, let alone raised objection to the nurse practitioner specifically.
