Judgment of infringement on three of plaintiffs' patents related to computer-based pricing of products, award of damages and entry of preliminary injunction are: 1) affirmed in part, as to the jury's infringement verdict, where sufficient evidence supported the verdict; 2) affirmed in part, with regard to the damages award, where plaintiffs made a prima facie showing of lost profits, the burden shifted to defendant to prove that a different rate would have been more reasonable, and defendant did not make such a showing, and the royalty award is supported by substantial evidence; but 3) vacated in part, because the permanent injunction is overbroad and defendants should be able to provide maintenance or additional seats for prior customers of its infringing products, so long as the maintenance or the additional seat does not involve, or allow access to, the enjoined capability.
