United States Federal Circuit

Allergan, Inc. v. Sandoz Inc., 11-1619

In patent infringement suit involving a combination eye-drop product used for treating glaucoma, the district court's findings that plaintiff's patent claims are not invalid, are: 1) reversed in part, where the district court erred in finding the claims of the '463 patent not invalid as obvious; 2) affirmed in part, where defendants, failed to prove by clear and convincing evidence that claim 4 of the '149 patent would have been obvious; and 3) affirmed in part, where there was no error in the district court's claim construction.
