Aspex Eyewear, Inc. v. Zenni Optical Inc., 12-1318
The district court correctly ruled that plaintiff was collaterally stopped from pursuing its infringement suit regarding patents for magnetic clip-on eyewear, based on earlier litigation between plaintiff and Altair Eyewear, Inc. for infringement of the same patents, where there is no material difference as to the claims now in suit and plaintiff's prior litigation with Altair, nor is there any difference between the Altair and defendant products to which the claims are applied.
