Brilliant Instruments, Inc. v. Guidetech, LLC, 12-1018

Summary judgment that plaintiff did not infringe defendant's patents relating to circuits that measure the timing errors of digital signals in high-speed microprocessors, is reversed and remanded, where: 1) there is a genuine issue of material fact as to whether plaintiff's products literally infringe the '231 patent claims; and 2) plaintiff's products do not do not literally infringe on the '671 and '649 patents, but defendant has created a genuine issue of material fact as to infringement under the doctrine of equivalents theory.
