United States Federal Circuit

In re Marsha Fox, 12-1212

The decision of the Trademark Trial and Appeal Board affirming the examiner's refusal to register petitioner's mark, "Cock-Sucker" in connection with rooster-shaped lollipops, as unregistrable on the ground that the mark "consists of or comprises immoral or scandalous matter," is affirmed where substantial evidence supports the Board's determination that the mark, taken as a whole and in context, has a vulgar meaning that will be perceived by a substantial composite of the general public.
