Presidio Components, Inc. v. Am. Technical Ceramics Corp., 10-1355
In a suit for infringement of patents related to electronic components used in electrical systems including consumer electronics, mobile phones, and audio amplifiers, the judgment of the district court is: 1) affirmed as to the court's finding that substantial evidence supports the jury's verdict that defendant's capacitors infringe the asserted claims of plaintiff's patent; 2) affirmed as to the court's denial of JMOL on lost profit damages where the record supports the jury's lost profits verdict with substantial evidence; 3) vacated as to the denial of plaintiff's motion for a permanent injunction as well as the court's ongoing royalty determination where the court erred in finding no irreparable injury; and 4) vacated as to the judgment in favor of defendant on its claim of false marking where under the Amendments to 35 U.S.C. section 292, defendant's appeal of its qui tam false marking counterclaim is moot.
