Osram Sylvania, Inc. v. Am. Induction Tech, Inc., 12-1091
In a suit for infringement of a patent, which claims a closed-loop tubular electrodes lamp having certain and specific discharge current and pressure parameters, district court's grant of summary judgment of invalidity of claims 1, 17, 25, 27, and 32 of the patent is reversed and remanded where: 1) there are genuine issues of material fact that preclude a finding of anticipation and obviousness on summary judgment; and 2) the district court erred in failing to consider objective indicia of nonobviousness.
