Brooks v. Dunlop Mfg., Inc., 12-1164

In plaintiff's qui tam action, alleging that defendant marked a guitar string winder with the number of a patent that was both expired and invalidated in violation of 35 U.S.C. section 292, district court's dismissal of the claim is affirmed where the Congress's retroactive elimination of the qui tam provision from section 292 does not violate the Due Process Clause or the Intellectual Property Clause of the Constitution.
