United States Federal Circuit

Comint Systems Corp. v. US, 12-5039

In a bid protest action against the United States and others, challenging the procurement of contracts by the Department of Defense for information technology services to other bidders, the Claims Court's dismissal of the complaint is affirmed where: 1) plaintiff failed to preserve its right to challenge the solicitation by failing to raise its objections before the award; and 2) it has not demonstrated standing to protest the agency's failure to award it a contract under the solicitation.
