Raylon, LLC v. Complus Data Innovations, Inc., 11-1355

In a suit for infringement of a patent directed to a hand-held identification investigating and ticket issuing system, district court's grant of summary judgment in favor of the defendants, denial of their motions for Rule 11 sanctions and denial of their motions for attorneys' fees and costs is: 1) reversed as to the denial of Rule 11 sanctions because the court abused its discretion in applying a subjective standard, rather than an objective one in evaluating plaintiff's conduct, and also abused its discretion in not considering some of defendants' arguments; and 2) vacated as to the denial of attorneys' fees because the court's evaluation of section 285 relied on its Rule 11 analysis.
