Fox Group, Inc. v. Cree, Inc., 11-1576

In a suit for infringement of a patent directed to a method and apparatus of a low defect silicon carbide crystal, district court's grant of defendant's motion for summary judgment on its counterclaim seeking a declaration of invalidity is: 1) affirmed as to the district court's grant of summary judgment in defendant's favor based upon the invalidity of claims 1 and 19 of the patent under 35 U.S.C. section 102(g); but 2) vacated as to its decision that the entire patent is invalid because there was no case or controversy at the time of the judgment over the remaining claims.
