In a suit for infringement of patents directed to a system that supports a portable conveyor assembly for transporting and stockpiling rock, sand, grain, and other aggregate material, the judgment of the district court is: 1) reversed as to the district court's conclusion that claim preclusion barred plaintiff's claim for infringement of the '101 patent because plaintiff's claims for trademark infringement and patent infringement constitute separate causes of action; 2) reversed as to the district court's dismissal of plaintiff's claims for direct infringement of the '231 patent where plaintiff's first amended complaint meets the pleading standard of form 18; and 3) affirmed as to the district court's dismissal of plaintiff's claims for indirect infringement.
