Transocean Offshore Deepwater Drilling, Inc. v. Maersk Drilling USA, Inc., 11-1555

In a suit for infringement of patents directed to an improved apparatus for conducting offshore drilling, district court's grant of judgment as a matter of law (JMOL) in favor of the defendant is reversed and remanded where: 1) defendant failed to prove by clear and convincing evidence that the asserted claims would have been obvious; 2) district court erred by granting defendant's motion for JMOL that the asserted claims are not enabled; 3) substantial evidence supports the jury's finding that defendant literally infringed the asserted claims; 4) the jury's damages award in favor of the plaintiff is supported by substantial evidence; and 5) it was an abuse of discretion to grant defendant's motion for a new trial where none of the alleged errors highlighted by the court warrants a new trial.
