Flo Healthcare Solutions, LLC v. Kappos, 11-1476
In an inter partes reexamination of a patent describing a mobile computer workstation intended for medical care environments, the decision of the Board of Patent Appeals and Interferences upholding the examiner's rejections of various claims of the '178 patent is affirmed where: 1) although the Board erred by construing the "height adjustment mechanism" limitation under section 112, the Board was correct in its ultimate conclusion that the claims do not require a length-adjustable vertical beam; and 2) the factual determinations underlying the Board's decision are supported by substantial evidence and the Board came to the correct legal conclusions based on those facts.
