Bowers Inv. Co. LLC v. US, 11-5102
In a suit against the Federal Aviation Administration (FAA) for nonpayment and underpayment of rent, the judgment of the United States Court of Federal Claims is affirmed where plaintiff's claims are precluded by his prior claim, which was appealed to and finally decided by the Civilian Board of Contract Appeals, and the claims in this case are based on the same transactional facts that could have and should have been raised and resolved in the prior proceeding.
