In Apple's patent infringement suit against Samsung alleging that Samsung's Galaxy Nexus smartphone infringes eight of Apple's patents, district court's grant of a preliminary injunction enjoining Samsung from selling the smartphone is reversed and remanded where: 1) the district court abused its discretion in determining that the irreparable harm factor counsels in favor of entering an injunction; and 2) the district court erred in its claim construction in its likelihood of success analysis.
