Mathews Int'l Corp. v. Biosafe Eng'g, LLC, 12-1044

In plaintiff's suit for declaratory and injunctive relief of noninfringement and invalidity of defendant's patents directed to the application of alkaline hydrolysis to the disposal of various types of waste, and also used by plaintiff to cremate human remains, the judgment of the district court is affirmed where: 1) the district court correctly concluded that plaintiff's dispute lacks the requisite immediacy and reality to support the exercise of declaratory judgment jurisdiction; and 2) plaintiff has failed to plead the bad faith element necessary to support its state-law claims.
