United States Federal Circuit
Wolfsen Land & Cattle Co. v. Pac. Coast Fed'n of Fishermen's Ass'n., 11-5113
In a suit filed by property owners claiming that the government's releases of water from a dam in central California unlawfully impaired their property rights in the water and inundated their land, the Court of Federal Claims' denial of environmental groups' motion to intervene as of right is affirmed where the district court correctly held that even if the groups had a protectable interest, and even if that interest related to this case in the manner contemplated by the Court of Federal Claims Rule 24(a)(2), the groups' interests were adequately protected by the government's participation in this case.
