Outside the Box Innovations, LLC v. Travel Caddy, Inc., 09-1171
In an action for infringement of patented tool carry cases, the judgment of the district court is: 1) reversed in part where there was not clear and convincing evidence of specific intent to deceive the examiner into granting the '104 application; 2) reversed as to the ruling of inequitable conduct because the district court erred in holding the patents unenforceable based on defendant's purported loss of small entity status; 3) vacated as to district court's rulings of invalidity of the disputed claims; and 4) affirmed as to grant of summary judgment of noninfringement of the tool bags.
