Evans v. US, 10-1303
In a landowner's Rails-to-Trails takings suit against the government on behalf of herself and similarly situated persons in several states, the judgments of the federal district courts in Kansas and Missouri denying joinder of the later-filing landowners as time-barred by the six-year statute of limitations under the Tucker Act, is vacated and remanded with instructions to dismiss the cases, where the remand ordered in Bright v. US to the Court of Federal Claims for decisions on the merits remains fully in effect.
