United States Federal Circuit
Santarus, Inc. v. Par Pharm., Inc., 10-1360
In a dispute over patents related to specified formulations of benzimidazole proton pump inhibitors, a class of chemical compounds that inhibit gastric acid secretion and help prevent and treat stomach acid-related diseases and disorders, the judgment of the district court is: 1) reversed in part where the court erred in holding that some of the thirty-six asserted claims would have been obvious over the prior art; and 2) affirmed in part as to its determinations that defendant failed to establish inequitable conduct and that certain claims of the '882 patent would have been obvious over a prior art.
