Woods v. DeAngelo Marine Exhaust Inc., 10-1478
In a suit for infringement of patents related to an apparatus that more efficiently cools exhaust as it exits the engine of a marine vessel, judgment of the district court is affirmed where: 1) having properly found that defendant's failure to supplement its interrogatory response was a violation of Rule 26(e), the district court was well within its discretion in excluding the drawings under Federal Rule of Civil Procedure 37(c) and in precluding defendant from relying on the drawings as prior art; 2) district court correctly declined to read unwarranted limitations into the disputed claim terms; 3) the district court did not err by denying JMOL of invalidity and noninfringement; and 4) the district court did not abuse its discretion in declining to sanction plaintiff.
