Activideo Networks, Inc. v. Verizon Communications, Inc., 11-1538

In a patent infringement action, related to interactive television systems and methods for delivering interactive television to subscribers, the judgment of the district court is affirmed in part, vacated in part and remanded where: 1) district court's judgment of infringement against Verizon as to plaintiff's '582 patent is reversed; 2) district court's grant of summary judgment of invalidity as to the Verizon '748 patent is vacated and remanded; 3) entry of a permanent injunction is against Verizon reversed; 4) district court's imposition of a sunset royalty against Verizon is affirmed; 5) district court's judgment of infringement with respect to plaintiff's '578, '678, and '883 patents is affirmed; and 6) the damages award against Verizon is affirmed in full as it has not argued either before the district court or on appeal that a finding of non-infringement of the '582 patent should result in a reduction of damages.
