Whiteman v. Dept. of Transp., 11-3165

In a whistleblower retaliation suit against the Federal Aviation Administration (FAA), the decision of the Merit Systems Protection Board (Board) dismissing the action is reversed in part and affirmed in part where: 1) the Board erred in concluding that collateral estoppel applied on the facts of this case as the disputed issue was not identical and was not previously litigated; but 2) the Board's judgment that any of petitioner's claims existing prior to the settlement agreement have been waived is affirmed.
