Gallo v. Dept. of Transp., 11-3094

The decision of the Merit Systems Protection Board (Board), denying a federal employee's restoration rights under 5 U.S.C. section 8151(a) is reversed and remanded, where the employee qualifies for restoration benefits based on length of service under section 8151(a) because the Board erred in interpreting "resumes employment with the Federal Government" under section 8151(a), as a physical separation from the federal government is not required under the section.
