In an action for attorneys' fees brought by a veteran after grant of a joint motion for partial remand (JMR), the Veterans Court's denial of motion for attorney's fees and costs is affirmed where veteran was not a prevailing party under the Equal Access to Justice Act (EAJA), 28 U.S.C. section 2412(d), and as a result he is not entitled to recover attorneys' fees and costs.
