In an infringement action involving patents relating to optical disc technology, the district court's grant of summary judgment of non-infringement for the asserted claims under both patents except for a de minimis claim of direct infringement that was later dismissed is: 1) affirmed-in-part where the court correctly granted summary judgment of non-infringement as to contributory infringement of the asserted claims of the '751 patent; but 2) vacated-in-part where the court erred a) in granting summary judgment of non-infringement as to induced infringement of the asserted claims of the '751 patent, and b) in granting summary judgment of non-infringement of claim 1 of the '966 patent based on an erroneous claim construction.
