Merial Ltd. v. Cipla Ltd., 2011-1471

In a case involving patented compositions for protecting dogs and cats from infestation with fleas and ticks, a district court judgment holding defendants in contempt is affirmed, where: 1) there was a valid exercise of personal jurisdiction under Rule 4(k)(2) of the Federal Rules of Civil Procedure; 2) a stay was not required under the "first-to-file" rule; 3) the district court appropriately considered both prongs of the contempt analysis as required under TiVo Inc. v. EchoStar Corp., 646 F.3d 869 (Fed. Cir. 2011) (en banc), and its conclusions were not clearly erroneous; 3) the contempt order was properly entered against both defendants; and 4) a permanent injunction against sale of the infringing product in the US was appropriate.
