Whitmore v. Dep't of Labor, 2011-3084

In a suit by a former employee against his employer, alleging that his removal was an act of retaliation for his whistleblowing disclosures and EEO testimony, a judgment of the Merit Systems Protection Board (MSPB) against the employee is vacated, where the MSPB abused its discretion regarding evidentiary matters, and failed to adjudicate the employee's whistleblower defense in accordance with the law.
