Chicago Board Options Exchange, Inc. v. International Securities Exchange, LLC, 2011-1267

In patent infringement litigation concerning competing automated systems for trading on commodity futures exchanges: 1) the district court's judgment of noninfringement is vacated because the district court misinterpreted several terms in the course of claims construction; and 2) the district court's denial of a party's motions for leave to amend its complaint is affirmed, where the district court did not abuse its discretion in denying the motions for inexcusable delay.
