Parsons Global Services, Inc. v. McHugh, 2011-1201
In a case in which a prime contractor submitted to the government a claim for payment under the Contract Disputes Act of 1978 on behalf of a subcontractor, seeking reimbursement for costs incurred as a result of the subcontractor's billing error, the Armed Services Board of Contract Appeals' dismissal for lack of jurisdiction is affirmed, where there was no valid "claim" over which the contracting officer had rendered a final decision, since: 1) the prime contractor's request for payment was routine as opposed to nonroutine; and 2) there was no dispute over the payment.
