Donnellan v. Shinseki, 2011-7127

In a case in which a veteran sought disability benefits, his appeal of a remand order of the Court of Appeals for Veterans Claims is dismissed, where the Veterans Court's decision fell within the class of remand orders that the Federal Circuit declines to review because they are not final, and did not fit into the exception to the rule against reviewing nonfinal orders, since even if the Federal Circuit were to have addressed the merits and upheld the appellant's legal claim, the case would still have had to be remanded for further proceedings.
