United States Federal Circuit

In re MSTG, Inc., 996

In a patent infringement action concerning a patent on 3G mobile telecommunications technologies, which the plaintiff eventually settled with certain defendants who were then granted licenses under the patents-in-suit, a petition for writ of mandamus challenging a district court order for the plaintiff to produce the settlement negotiation documents is denied, where: 1) settlement negotiations related to reasonable royalties and damage calculations are not protected by a settlement negotiation privilege; and 2) the district court did not clearly abuse its discretion in ordering production of the documents.
