Advanced Fiber Technologies (AFT) Trust v. J&L Fiber Services, Inc., 2011-1243
In a patent infringement suit involving patents on screening devices used in the pulp and paper industry: 1) the district court's grant of summary judgment of noninfringement is reversed and the case remanded based on the district court's incorrect construction of one of the asserted claims; and 2) the district court's grant summary judgment to the defendant on the issue of willful infringement is affirmed, where the plaintiff failed to raise a genuine factual issue that any infringement by the defendant was willful.
