Ebel v. Shinseki, 2011-7125

A widow's appeal of a decision of the United States Court of Appeals for Veterans Claims is dismissed for lack of jurisdiction, where: 1) the decision of the Veterans Court, vacating and remanding a decision of the Board of Veterans' Appeals that denied the widow's claim for service connection on behalf of her deceased husband, was not a final decision; and 2) the exception to the finality rule did not apply, because the Veterans Court decision was not a clear and final decision of a legal issue over which the Federal Circuit had jurisdiction.
