Simanski v. Sec'y of Health and Human Services, 2011-5050
In a case in which parents filed a petition with the National Vaccine Injury Compensation Program for compensation due to injuries suffered by their daughter, the dismissal of the petition is reversed, where: 1) the special master should not have dismissed the petition due to the parents' failure to supplement an expert witness's reports, and 2) the special master's analysis of the merits should have been conducted in accordance with conventional summary judgment standards.
