Fort Properties, Inc. v. American Master Lease LLC, 2009-1242
In a case challenging the validity of claims in a patent disclosing an investment tool designed to enable property owners to buy and sell properties without incurring tax liability, the district court's grant of summary judgment against the patent holder is affirmed, where: 1) the claims not involving a computer were an abstract idea and not a patentable "process" under 35 USC section 101; and 2) the claims involving a computer also were not patentable, as adding a computer limitation to claims covering an abstract concept was insignificant post-solution activity.
