United States Federal Circuit

Celsis In Vitro, Inc. v. Cellzdirect, Inc., 2010-1547

In a patent infringement suit by an assignee of a patent of methods for preparing multi-cryopreserved liver cells, the grant of a preliminary injunction is affirmed, where the district court did not abuse its discretion in finding: 1) a likelihood of success on the infringement claim; 2) a person of ordinary skill in the art would not have considered the claimed methods obvious at the time of the invention; 3) the plaintiff would suffer irreparable harm absent a preliminary injunction; 4) the balancing of harms favored the plaintiff; and 5) the public interest favored a preliminary injunction.
