Younies v. Merit Systems Protection Bd., 2011-3031
In an appeal from an order of the Merit Systems Protection Board (MSPB) dismissing petitioner's appeal, order is affirmed because substantial evidence supports the MSPB's determination that it lacked subject matter jurisdiction where the Department of Labor did not rely on pre-probationary reasons in terminating petitioner's employment.
