CCA Associates v. US, 2010-5100
In a challenge to a finding of the trial court that the enforcement of the Emergency Low Income Housing Preservation Act, (ELIHPA) and the Low-Income Housing Preservation and Resident Homeownership Act (LIHPRHA) resulted in a temporary regulatory taking, judgment is affirmed where, on the economic analysis outlined in Cienega X, the court erred on its takings order, but affirmed where Cienega IV forecloses plaintiff's breach of contract claim.
