United States Federal Circuit
Tianrui Group Co. Ltd. v. International Trade Commission, 2010-1395
In an appeal from a determination of the International Trade Commission (ITC) that the importation of certain cast steel railway wheels violated Section 337 of the Tariff Act of 1930, determination is affirmed where the ITC: 1) did not exceed its jurisdictional reach in holding that importation of articles derived from the theft of Trade Secrets in China run afoul of the Act because Section 337 applies to conduct in a foreign country; and 2) correctly determined that the offending imports threaten to destroy or substantially injure an American industry.
