Engage Learning, Inc. v. Salazar, 2011-1007

In an appeal from a decision of the Civilian Board of Contract Appeals dismissing plaintiff's appeal for lack of subject matter jurisdiction under the Contract Disputes Act of 1978, 41 U.S.C. section 601 et seq., because plaintiff failed to establish that it had a contract with the government for the unpaid services, judgment is affirmed in part and vacated in part where although the Board erred in dismissing the appeal on jurisdictional grounds, but it could have dismissed in part for failure to state a claim upon which relief can be granted.
