Samish Indian Nation v. US, 2010-5067
In an appeal from a judgment of the district court dismissing, for lack of subject matter jurisdiction, an action by plaintiff seeking treaty rights and acknowledgment for statutory benefit, judgment is affirmed where the court correctly dismissed some of plaintiff's allegations because the Tribal Priority Allocation system is not money-mandating, but reversed as to plaintiff's State and Local Fiscal Assistance Act (Revenue Sharing Act) allegations because the trial court's ability to provide monetary remedies under the Revenue Sharing Act is not limited by operation of the Anti-Deficiency Act, 31 U.S.C. section 1341.
